Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ProductScene (“the Service”), operated by ProductScene (“we”, “us”). By creating an account or using the Service, you agree to these Terms.

1. The Service

ProductScene is an AI-powered product photography tool. You upload a product image; we generate marketplace-ready images using AI models. The Service is provided on a credit-based system where each generated image consumes one credit.

2. Account

You must be at least 18 years old to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at support@productscene.com if you suspect unauthorised access.

One person or legal entity may not maintain more than one free account.

3. Credits and Payments

Credits

One credit generates one image. Credits are consumed when a generation job is queued. If a generation fails due to a service error on our end, credits are automatically refunded to your account.

Free credits

New accounts receive 5 free credits. Free credits do not expire.

Paid plans

Paid plans are billed monthly in advance. Monthly credits do not roll over to the next period. Unused credits at the end of a billing period are forfeited.

Refunds

We offer a full refund within 7 days of your first paid subscription if you are unsatisfied with the Service. After that, payments are non-refundable except where required by law. Credits purchased as top-ups are non-refundable.

Price changes

We may change prices with 30 days' notice. Changes take effect at your next billing cycle.

4. Acceptable Use

You agree not to use the Service to:

• Upload images you do not own or have rights to use
• Generate content that is illegal, harmful, defamatory, or violates third-party rights
• Attempt to circumvent usage limits or reverse-engineer the Service
• Resell or redistribute the Service without our written permission
• Use automated scripts to interact with the Service in a way that overloads our infrastructure

We reserve the right to suspend or terminate accounts that violate these rules without notice.

5. Your Content and Intellectual Property

Your uploads

You retain ownership of any images you upload. By uploading, you grant us a limited licence to process and store your images solely to provide the Service.

Generated images

You own the images generated by the Service and may use them for any commercial or non-commercial purpose, including on marketplace listings, social media, paid advertising, and print materials. No attribution to ProductScene is required.

Our IP

The Service, its interface, and underlying technology remain our property. Nothing in these Terms transfers ownership of our intellectual property to you.

6. Availability and Uptime

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance with or without advance notice. We are not liable for losses caused by downtime or service interruptions.

7. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not warrant that generated images will meet any specific marketplace compliance requirement — always review images before listing.

8. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability to you for any claims arising out of your use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

9. Termination

You may delete your account at any time from Settings. We may suspend or terminate your account if you breach these Terms. Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

10. Governing Law

These Terms are governed by the laws of the European Union and the jurisdiction in which we are established. Any disputes shall be resolved in the applicable courts.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
